Hi, I am not sure if this is covered elsewhere and if so sorry for asking again.

I was made bankrupt in 2011 and automatically discharged in 2012. My IPA will come to an end in April 2014 so I am not starting to think about having a normal life again.

I ordered my statutory credit report from Experian, and it shows a debt with HSBC that was prior to bankruptcy and was a part of my bankruptcy as still outstanding. As I understand, the debt should be written off by the bankruptcy (and all other creditors have done this)

Am I correct?

If so, what is the best approach to take with HSBC? (If I just call them I am pretty sure I will just get into a call centre who will not be able to help, and I dont want to call until I know what my rights and obligations are...)

Great advice from Niobe. Your credit report should have the details of the data controller for you to write to. Ask them to amend the default date to your bankruptcy order date and to mark it as satisfied.

Hi,

If the debt was included in the BR then it will be written off.

I suggest you send a copy of your discharge to the data controller at HSBC and tell them to remove the dates of the outstanding debt to the date of the original BR.

Bear in mind that the BR will remain on your file for six years when it was declared.
