My IVA failed after 4 payments as I thought I could pay more than I could afford - my own fault, I know. I am going to court next month to petition for bankruptcy, and up until lunchtime today I was convinced that I am doing the right thing. I phoned Gregory Pennington to find out more information about their managed bank account, but the guy on the phone kept asking me have I thought about re-presenting my IVA, did I want them to look into it, am I sure BR is the right thing etc. I know deep down that I am doing the right thing, but that phone call really upset me and I kept thinking of all the negative things about BR.

My main worry is that the OR will say I have a beneficial interest in my partner's flat. I have lived here for a year, and when I moved in the agreement was I would pay just under half the bill, by the food and pay my partner £200 towards the mortgage. I moved into the flat in March last year and from March to August the only thing I paid for was the food as I was trying to pay my loans and credit cards. From September to November I paid for the food and gave him £200, and he ended up giving approximately half back to me as I was struggling with my IVA payments. From December onwards I have paid only £100, plus food.

Do I need to state that I have an interest in the property on my SOA? If we split up I would walk away with nothing - my name is not on the deeds, the mortgage or any of the bills. Any money I have given to my partner has been cash.

Sorry for rambling, but I really don't want to involve my partner if I can help it!

The property is in your partners name , your beneficial interest is Zero, the O.R. will not pursue you for your alleged equity stake. Unlike some IVA's which can consider your partners income, bankruptcy is for an individual.
