I am considering bankruptcy! I have a joint bank account with sizeable overdraft in my ex-wife's married name! Will bankruptcy affect her generally and her credit rating!

Hi Gareth

Lots to consider with regard to bankruptcy so you really need to understand what you are doing and what the consequences are.

If your wife is now an ex then only debts in JOINT names are goint to effect her. I.E. if you went into Br then your liability for the bank account would be ended but the bank would then pursue her for the full ammount.

If she has not had anything to do with the account for a significant time then it may be possible for you both to ask the bank to separate the account and perhaps you each take a proportion of the debt.

How large is the O/D?
