Posted - 14 March 2008 : 13:52:29 I wonder if anyone could help me answer my questions?
I declared myself bankrupt eight years ago and was discharged in 2002,so anyway back to now i have got myself in to debts again of 23,000 i am in contact with a third party finicial advisor who has drafted up an iva for me of which a meeting was held yesterday of my creditors and everyone agreed to it but a couple of hours afterwards my financal advisor rang me back to say a 5,000 debt from barclaycard has come through in my name, but i do not know where this has come from so now i dont know if i will be able to go aheard with my iva.my question is to the experts would this debt be from my bankruptcy eight years ago?if so i thought it would be all wiped away as i was told this at the time.or do you think there is any possiblity that it might be my twin sisters debt as she is doing a iva and she had a barclaycard roughly around that amount is there any chance they could have got us mixed up as she lives at the same address as myself and same date of birth just a different first name.would this be a possibily and could this happen? Thankyou in advance if anyone can help me.

It is certainly possible that an old debt has somehow got allocated to the wrong person but the only way of confirming is actually getting the details from the IVa company and phoning barclaycard to identfy who's debt it is.
If the debt was yours and before your br then that is eliminted by the br. however if it is your sisters then that needs to be allocated correctly to her iva .
they won't shout at you so don't be worried to make the call.
good luck
