Posted - 19 March 2008 : 18:10:18 Hi My current situation is that i owe £22000 in unsecured loans and credit cards which i have been struggling to pay since i had an heart attack in october 2007 which has left me on incapacity benefit of £65.00 per week .
I feel that bankruptcy is my best option as i am only surviving by using credit cards to pay bills.
I have no assets and live in a council flat.
I have worked for the last 25 years as a motorcycle courier and if i go bankrupt will i be able to keep my motorcycle worth £1200 as though i am currently on benifits i am hoping to return to work and will need it as its a tool of my trade.
Thanks for any advice.

the royal courts of justice is a big place. and there is quite a lot to do on the day.
You need to go in the main enterance ( as seen on TV) go through the metal detectors and go to the reception desk. They will give you a map layout of where to go.
FIRST you need to turn right out of the lobby to the cashiers office and get your SOA stamped after paying the fee. There is always a que so get there early 9.10amish
Then off the the Thomas Moore Building at the other end of the courts. 5 minute walk at least!.
If you have time go before the big day to scope it out so you are not flustered on the day.
After you have given the Br clerk the docs they will send you away and ask you to retur late ( 2 - 3 hrs) to collect the Br certificate& SOA.
Then off to the Official Receivers building ( they give you a map) about 15 mins walk ( quicker to walk than taxi!!!!)
In the 30 minute interview is the best place to hand in c cards / bank statements etc etc etc .

Posted - 31 March 2008 : 10:44:10 There is no need to take any documents to Court with you apart from the bankruptcy application papers. And it is not usually necessary to book an appointment in the High Court, but these days the Court is very busy, so get there early if you can. Might be an idea to ring them first to see if they do operate any appointment system. |

I decided to fill in the SOA online and have printed 3 copies but do i also need 3 copies of form 6.27 ?.
On the day i go to the court is it worth taking my bank statements/credit cards or will i not need to hand them in until i see the O R ?.
My local court is the royal courts of justice in the strand. Do i need to book an appointment or can i just turn up on friday morning ?.
Also do i go in the front entrance on the strand ?.

Welcome to the forum, as your vehicle is worth less than £2500 then there should be no problem, however as you are not working and claiming benefits they would see the need for you to have a vehicle is not great and would ask you to sell this, if you explain to them that you are to return to work soon and require the vehicle as your main tool of trade this should cover the issue and allow you to claim your bike as exempt property.
