Posted - 13 April 2008 : 19:03:41 Hi ,I am seriously considering a BR .Can someone tell me please if you are in receipt of Motability Allowance which is taken to cover a Car ,tax and insurance can the Court make you return this car.Both my husband and I are Disabled both in receipt of Higher rate of Motability and Lower rate of Care As I cannot walk far or climb stairs my husband used his Motability allowance to buy a small motor home so we can visit Family occassionally this not through Motability itself except he has nil tax will this be taken as well?!!!!!!![ Thanks for any advice

If the vehicle is obtained through Motability finance then you are simply swaping your allowance for a vehicle under their scheme. One would need to read their agreement carefully to ensure that it is OK.
As your situation is different then I would suggest you seek professional help as you will need to identify the equity in the vehicle, liaise with the OR's office and ensure that the HP company are onboard and ok about letting you keep up the payments.
What level of debt do you have and other than the motorhome do you have any other assets?
