Posted - 16 April 2008 : 20:41:32 i need to fill in a N244 to stop an eviction but not sure how it would be worded,breif details of my case i was made bankrupt in may 2005 and discharged in nov 2005 and have the papers,i tried many times to remorgage but was having great problems,in nov 2007 my ip was granted a possesion order for house and i had to leave by the 3rd dec 2007,in jan 2008 i recieved a letter from my morgage lender saying that they were in possesion of my house and that they were selling my property,on the 25th march 2008 i recieved a letter from my lender saying that they have gave the property back to myself all was good until last friday when i recieved a letter from the court baliffs saying the ip was evicting me on 2nd may,whilst the property was with the ip i was broken into and set on fire and flooded the value has droped by 40k,i am hoping that if i file this form i will get time to work out what is happening can anyone help |

Posted - 27 April 2008 : 13:19:28 well i have filled the N244 last week and yesterday recieved the other sides statements,it was the biggest fairy tale going,well the court hearing is 30min before my eviction so i can only wait and see. cheers guys |

which area of the country are you in?
Is the TRUSTEE in Bankruptcy evicting you because there was equity in the property that they want to release for the benefirt of the creditors ?
or
Did the mortgage company want to evict you because of ongoing mortgage arrears?
really suggest you speak to one of the specialist experts here on the forum by phone tomorrow to give them the whole picture.
Clearly time is running out and best not to waste the opportunity of some free advice on the phone tomorrow.
