Posted - 18 April 2008 : 23:20:33 In April 1998 I declared myself Bankrupt. At the time I was a mature student and being disabled was not in work. I had no assets apart from a personal pension this I declared to the Official Receiver. No payments have been made into this pension since 2002 when some compensation for mis-selling was paid in. I was discharged in April 2000.
In view of the fact that I am 50 in a few weeks time am still disabled and do not work and the amount in the pension fund would provide me with about £600 per annum at 60. Would it be possible in your view to obtain the monies from the pension fund so that my debts can be cleared and the remainder given to me. I can assure you the monies will be a lot more use to me now than when I am 60. Thanks for your time and trouble. Regards Bill

You need to check this out with the OR who originally dealt with your case, but I feel that your pension scheme is an asset which vests in the Trustee. Since 2000, pensions have been ringfenced from bankruptcy proceedings, but this did not happen retrospecitvely, so you might find that you do not own the scheme at all.
Check to see if the OR has it listed as an unrealised asset, or whether they have lodged an interest with the pension fund managers.
