Hi,

I will be made bankrupt next Thursday - I have an outstanding payment for council tax for £100, I was wondering how the OR would view it if I used my card to pay this prior to bankruptcy.

Hi Brett

Thanks for the quick reply.
They never got as far as the attachment of earnings even tho they tried three times, 1st time I was made redundant as part of a redundancy programme 2nd time I quit my job (stupidity tho depressed) and the third time they tried I was retired by my consultant. I started paying £6 a fortnight as that was and is all I can afford but with all the problems with my bank account closing I forgot the standing order for the arrears and they have just sent a 1st reminder. I can now let them know my intentions as regards to the remainder of the arrears.

Hi Storm,

If the debt was outstanding from the previous year’s council tax then this can be included in your Bankruptcy the current year can not.

The attachment of earnings order will be stopped as part of the Bankruptcy also.

Hi Brett & Melanie.

I was told that Council tax arrears could not be used as a debt in bankruptcy, I was told this after having an attachment of earnings order before I was retired. I was told this by a council worker at the court and it was backed by the duty solicitor. Can you confirm please if this is the case because if its not and I can put it as a debt then I won't bother setting up a new standing order but put it in my SOA and nform the council what I intend to do with it.

Thats what I was worried about - not be ing able to pay in installments. We've phoned them and sorted it out now so I won't be using my card.

Hi Matt,

Is this your current installment?

Technically council tax debts can be included in Bankruptcy if this was for the previous year, the risk you face if this is an installment on your current years council tax is that you loose the right to pay by installments.

I would suggest you contact the council and explain about the Bankruptcy and ask if you can spit the £100 payment over the remainder of the year rather than worsen another creditors position.

Why would you want to do that? The outstanding countil tax bill will be included as a debt in the bankruptcy, so I cannot see the logic of worsening another creditor's position to the advantage of another.
