Posted - 23 May 2008 : 19:53:46 Hiya, I was declared bankrupt on Weds & had my first contact with the OR today advising me my interview will be next Friday... On my paperwork I declared that I had sold my car for £2k to my bf, I used £500 for the fees & have the rest to give to the OR, I was advised I should sell my car however after speaking to my case worker on Weds she said I had jumped before it was nesseccary, had I not declared I had sold the car she thought it would have been ok to keep it. During the call today the OR asked for the money, I did argue the point that I had been told that I might be able to keep my car,she argued that the car was worth nearer £3k (it needs alot of work doing to it to make it worth £3k) I still need a car to get to work?? The examiner didnt seem particurly helpful, in fact she made me feel quite dirty, I think she thought I would write a chq for £1500 that would bounce - again on Weds I was told the acc I opened with the Co-op that had a visa debit card & chq book would be ok to keep as long as the bank were happy with it & they were... I told her I was also available only on my mobile on Fri - again she made me feel like this was wrong. I know this isant a pleasant experience and she is certainly making that the case... Posted - 24 May 2008 : 16:56:01 Hi Tikka Sorry you have had a tough time with your OR. Hopefully you'll hit it off better when you speak to her again. Try not to take offence at what she is doing and saying - it's not personal...although I know it feels it sometimes. Sounds like you may have been given some iffy advice about selling the car but what's done is done and atleast you used some of the cash for your court fees - now the OR can't complain about that!! Good luck with your interview

Posted - 24 May 2008 : 15:43:42 Sorry I meant to say, yes I was advised that I should sell the car prior to going bankrupt, I even asked my advisior again after finidng this website & discovering if the car was worth about £2k that it might be ok to keep it. He told me that it could go either way but in his experience of the OR in my area he felt they would take it from me, even gave me an example of a single mother owning a £500 car that the OR took from her... I felt that I should sell it to my BF rather than run the risk of the OR taking it and having nothing..... |

Thanks for your replies.
I know I have sold the car & I signed an affidaviat to that effect so I know this is correct, I have posted a chq of to the OR for the £1500 I had left (she was a bit iffy about me sending a chq thinking it would bounce!) I am lucky that I still have use of the car & I will pay my bf back the £2k he effectively lent me.
I can understand there reasoning for wanting a land line number but I am sorry I was not about to my interview with the OR in my office. I cant have the afternoon off.
Just preparing all the paperwork to send back to the OR this afternoon, have a feeling tho the interview wont be easy.
I am sorry I got myself into this mess, she just made me feel even worse than I already do!

Posted - 24 May 2008 : 01:00:33 The problem you have now is that the car is no longer a car but has been sold and the asset is now cash. I am afraid that you cannot use the argument that you need to keep that cash to buy a new car - were you actually advised to do this or did you do it off your own back?

You did jump the gun as a car valued for around £2500 would have been ok for you to keep you could have argued with them over the £3000 valuation, however you have sold the car so they will want the balance of the money.
The examiners don't like calling mobile phone numbers as it costs them more money and they get ear ache from the powers that be, they like to have a land line number where possible.
Everyone has a bad day and maybe you just caught this particular examiner on an off day.
