Hi
We were officially declared BR on 7th April, prior to this we tried to have and IVA with Synergi, this didn't get through although we did pay them £604, Synergi have now decided to give us this money back, the OR said we have to hand this over, is this correct, this money was paid to Synergi before going BR, I asked if we could use this money to get up to date with the mortgage but they said it had to be sent to the OR.

Indeed I'm afraid the OR has every legal right to this money.

The money is deemed to be cash due to you and therefore the OR is correct to demand it for the benefit of the estate.
