We were going to present our bankruptcy forms at the end of this month (May) but unfortunately our old jalopy of a car broke down -and since I work at night and cannot do without it - we had to use part of the money we had put by towards the bank costs to pay for the repairs. Meanwhile demands have already started dropping through the letter-box.How do we keep the creditors at bay for another month, that is, if nothing else crops up to swallow up another chunk of whatever money we can put by again --we have no savings at all as it is!! Thanks a million!!

Hi Modensane,

If you are both going to be declaring Bankruptcy at the same time you will still be individual Bankruptcy cases, however you will require a similar income and expenditure on each as most outgoings will be the same.

They may differ slightly in the event you were to have two vehicles so the expenditure for fuel, maintenance etc will differ slightly.

If this is the case As Vicki points out put the whole income down for the party going Bankrupt and then discount the others income for their individual vehicle costs and enter this in as the contribution and visa versa.

The likelihood is the examiner you deal with will reserve both cases to be dealt with together if you both declare Bankruptcy at the same time then you will more than likely be interviewed together.

Hang on there for a BR expert to come online - I went BR on my own so am not 100% certain what is the way to handle your forms.
I bet you will be so pleased to get it over and done with - I know I was!
I can sleep all night now!!!

We are both filing for the BR; and here too we will need advice:
1. Can we present one I & E as a couple like we
did during the IVA. We cannot figure out how it
can be otherwise,
2. Can we go for the OR's interview together as a
couple?

No problem....
I only earn £435 a month and my hubby (who hasn't gone BR) contributes £850 of his £1400 income each month. (bless him!)
Section 7.1
Rent - £315 - total amount
Housekeeping £350 - total amount for 2 of us
Heating - £155 - (£80 oil/rest electric - actual amount each month)
Water - £42 - actual amount
Telephone - £50 - landline plus my mobile
Travel - £75 - my travel costs only
Clothing - £50 - both of us
Maintenance - £26
Council Tax - £91 - actual amount

Other essential payments..(these are all mine)
Car ins - £30
MOT/Tax and Maint - £30
Contents ins - £16
TV lic - £12
Optician - £10
Dentist - £5
Prescription - £7
Holiday - £20
Hair £10

Total = £140

So my total outgoings = £1294
My earnings plus hubbys contribution = £1300

My hubby pays for things like broadband, pet insurance, his own bank loan and he smokes (!!) so once I deducted all these things from his income his contribution was £850.

Hope that makes sense - will be about later if you need me to explain anything!!!

Hi there - there is always something unexpected!

Tell the creditors you are petitioning for your own BR in June (or whenever) and if they want to do it sooner then they can!!

Don't be pressured by them - they have missed their chance to help you.

It'll soon be over!
