It wasn't until I received my Bankruptcy Order in the post at the weekend that I realised I hadn't passed on this info! When in front of the judge on Friday I asked him if my BR definately had to be posted in the local paper. I was a dithering wreck by this point but managed to explained I had been in an IVA for two years and any creditor I had already knew of my insolvency and were included in the IVA. He granted permisson and has ordered that it does NOT go in the local press and for the extra fee of £30 (he did ask if this could be waived too) I now have a second court order to that effect! See....they are human after all. I know that this won't happen in every occasion, and maybe the fact I have been in an IVA for two year helped enormously, but if you don't ask you don't get!

Posted - 15 May 2008 : 07:56:30 Hi Stuffed - just ask - if you don't ask you dont get! My judge on the day I went BR was really understanding so that helped. It sounds like you have "evidence" so present it to the judge and see what happens. Good luck - Will keep my fingers crossed!

Posted - 14 May 2008 : 08:31:20 We have the incident number, a video of the harassment that was used by the police, and two years of diaries that the police advised us to keep to indicate the level of harassment that we were receiving.
The ex received a formal police caution which we understand was in itself an admission of guilt. I spoke last night to a solicitor who has suggested applying to the court to get a stay of advertisement. He was very helpful. We decided a few years ago that we had no other choice but to move home away from this person and they are unaware of where we now live. I am desperate for the sake of our Kid's to keep it that way. |

Posted - 13 May 2008 : 22:49:08 The decision not to advertise a bankruptcy is actually quite rare, and you will probably need to show police records indicating the harassment you have received from your partner as evidence of your request.

I asked the judge on the day. He gave me a second court order to stop in going in the local paper. It cost an additional £30 - but worth every penny. You just have to ask and have a good reason why. Good luck

Posted - 13 May 2008 : 11:55:38 I am due to go Br tomorrow with a creditors petition. Have had some problems with an ex and he has been done for harassment. I would prefer it if he doesn't know where I live. What forms do you need to fill in to request that the BR is not advertised? How do I sort it out with the court in London before tomorrow? Any help would be appreciated.

As I mentioned Bankruptcy still carries with it a certain stigma, however the officials you deal with are not without compassion for your situation and if you don't ask you don't get.
