Posted - 08 May 2008 : 08:29:01 We are due to go BR next week. My other half is a freelance linguist and is self employed. We are planning on spending some time in Europe this summer for him to build on his business contacts. We will be staying with friends or in a tent. Will the OR have finished with us if we allow 8 weeks between BR and going abroad?. Need to book the ferry crossing fairly soon and don't want to wait till prices go up. Can the OR refuse to let us go?

Posted - 09 May 2008 : 17:19:46 Dear Stuffed The point of bankruptcy isn't to stop your partner earning a living, it's a way to deal with your debts once and for all. Although you have to "attend on the official receiver as [he] may reasonably require " if you are travelling on business then that's as good an excuse as you could have. Normally you will have a first, brief call to the official receiver's office when you are still at Court having been made bankrupt; explain the situation at that stage; ask to attend for an interview before you go or after you come back. If your cases are straightforward the official reciver may just opt to interview you by telephone; you may be able to arrange to make the call from overseas. Posted - 09 May 2008 : 15:38:52 I am concerned because we will be away for so long. I don't want to seem to be difficult with the OR, but what if he needs information when we are away?
We will of course give him all the information they need as quickly as possible but I am worried that 8 weeks won't be enough and they will make us stay in the UK.
I have arranged it so that we will stay with friends or in our tent but as the trip will last about 5 - 6 weeks I don't want the OR to refuse to let us go. Are you sure that they can't stop you going abroad so soon after BR

Normally your OR visit or telephone interview is within 10-14 days of your Court Date.
The examiner will deal with most things at the interview, but it would depend on what they find during the course of investigation as to whether they would want to see you again.
They will not stop you going abroad you will just have to keep them informed with regard to income etc.
