iam disabled and on incapacity benfit,dla upper for mobility and middle for care,child tax credits,child benefit and income support. i have a motability car live in a private rented flat with the rent paid from housing benfit council tax bnefit pays the ct i get about 950 a month into my acc,i owe aprox £26000 to about 7-8 creditors if i wastogo bankruptwhat would i be allowed to keep ie internet, mobile 4 myself and my 15yr old son,car,flat,etc i am not sure what the best thing to do is, i know it cannot carry on like this for very long i currently have a debt management plan but am strugling to pay it, what do you advise, sorry this so vague but i am not very good at explaining myself

Hi Eamonn,

Benefits are what the government deems to be the minimum one can afford to live on therefore as Vicki mentions you would have no disposable income on the basis of which to pay an IPA

Hi Eamonn, benefits are generally income based - you get enough to live on - so in theory you don't have a disposable income. No disposable income - no IPA.

i have heard that income from benefits is not counted in br is this correct, asmy only income is from benefits. how would this affect me????

Hello Eamonn.
Other than having a young 'un I am in a similar position to you with DLA, SDA, income suppotr etc. I am lucky to have a local council flat rather than be at the whim of a private landlord!
I just had my interview with the receiver and she didn't even go through the expenditure page with me being on means tested benefits! She has written to Motability to say that she has No Interest" in the car I have out of my DLA. She didn't mention mbile phone or internet (Both are pretty necessary to me) so Don't worry too much.
I had the debt management thing going for a couple of years but I was missing payments on one thing to pay another too often. Bankruptcy has really lifted a weight off my shoulders!

As long as the car is a mobility car and I guess it is as you get the mobility component of teh DLA then that is safe and the OR can't touch it as you don't own it. Motability own the car. I am in a similar position myself and was relieved to find out that the car was safe

Hi Eamonn and welcome to the forum

I feel sure that you would be allowed to keep most of your expenditure, as the internet is obviously a necessity for you. Bankruptcy will give you a fresh start and hopefully more money than you currently have available under the DMP.
