Posted - 13 May 2008 : 10:56:36 I and my husband are planning to go bankrupt. We have been with payplan for 6 months but together we owe £55k (15k mine and 40k his - al seperate)and with my husband in temporary work an IVA isn't possible and together we don't earn enough for IVA. we have a car but we need to spend some money on it. Its an R reg and has not had any attention for 3 years due to money probs. What is the max we can put for car maintenance on the State of Affairs. At £50 per month, its £600 for year, which would allow a service but no repairs. Would OR allow more.
Also we have just bought our house 6 months ago and have a mortgage of £95k. We bought from Housing Assoc and would owe them 8% of sale price from sept 08-09, then 6% from 09-2010, and 4% from sept 2010-11. Valuation is at £99,995. Do you think we will loose our house. Also redemption fee of £6500 to mortgage company if we finish mortgage before Sept 09. Can OR tell us they will take the house 3 years after bankruptsy or do they have to do it in the first year.
I am 99% sure this is what we need to do but is very hard going through trying to stay sane and see a life after.

1. Car - 50 pm is a little high for maintenance in br - more likely to accept 30 - 35 ( MOT @ 50, service at 150 and repairs / tyre at the rest)
Have you thought about speaking to payplan and reviewing the liklihood of having a short payment break for a few months while you try to get full time permenant work again?
2. House Who has valued the house and when was it valued? Estate agents tend to be a little optimistic at real values and if the 99,995 was the figure you bought it 6 months ago then you are likely to be in negative equity as house prices seem to be dropping around the country. Which part of the UK do you live in?
We will advise on the house further when you can help with the info re valuations
