i am in debt of about £8000 and can not afford the repayments,i also have been on debt mangement and could not afford the payments to them, i got taken to court and now one of the creditors aer going to take money from my wages every month,and now i also have to tackle the other two creditors,and i simply can not afford to do this any of this, so my question is do you think i stand on suitible ground to file for bankcrupcy. i live with my girlfriend and her three children and she does not work so we recive working tax credits. sorry for the bad spelling

Hi Tristan,

It seems a shame to look at Bankruptcy for such a low amount, but if a debt management plan did not work then I would say Bankruptcy is your best option and would free you from this overwhelming debt as well as cancel the attachment of earnings you have been given.

Hi Tristan,

I would suggest a call or visit to the CAB but judging by what you have said then BR is the only option as you can't pay your IVA. This would also stop the attachment of earnings order on your wages but you might end up with an IPA/IPO from the OR.

If you decide on the BR route then when you fill out your SOA you will need to say how much your partner pays towards the bills out of the tax credits.

Hopefully an expert will be along soon to add and possibly correct something I have said.
