Posted - 19 May 2008 : 13:17:22 Hi. Im thinking of applying for bankruptcy the only things worrying me are the following
- My parents live abroad in the EU, can i still go out and see them or do i have to wait to be dismissed, also what is the rule?no holidays during the first year? because i sometimes work abroad aswell
- Im worried about my job, im in I.T so not really anything to do with finance, im just worried about telling my boss/payroll about my situation, any advice?
- I have a car, its worth about £3000 and i use it to get to work, i know they will take this off me, not sure if i can afford to purchase a cheaper one. will they tell me to start using public transport?, only problem i have with this is that my work require me to have a car as im on call and work 14miles away, i also do really odd shifts sometimes like overnight so there is no transport

You can include utilities within your Bankruptcy, but usually aged amounts.
If in doubt put it down and the OR will tell you what you can and can't include.

Posted - 19 May 2008 : 16:48:32 I need an expert to tell you what to do about utility bills, I didn't have any debts for them in my BR. As for any other debt it gets listed in your SOA and included in your bankruptcy. Are you getting hassled by creditors? I was - phone calls, letters, threats of CCJs etc etc. They all stop as soon as they know you are going BR, or as soon as you or the OR give them your BR ref number. It does get easier. An expert will be along soon to answer your question fully.

Posted - 19 May 2008 : 15:31:28 Paddy There aren't attachments from earnings - anything you pay to the OR is direct to them not through your pay - so don't worry about that. There's only really the nil tax code that your employer could be aware of if you work for a small company - you could say you are entitled to a tax refund so your code has been adjusted to repay that? There's no mention of BR when the tax code is changed either. You have exactly the same worries I had - keep sharing them with the forum and put your mind at rest.

Posted - 19 May 2008 : 14:26:28 I'm fine.........day off......been staining my shed...and the dog...and my feet! Before BR the shed could have fallen apart - after BR I can start to think about things other than debt! Thank you again!

Posted - 19 May 2008 : 14:17:52 Hi Paddyuk I can only advise you from my own experience of going BR. I have been allowed an allowance each month for a holiday - so although its not much you are allowed a holiday -cheap and cheerful - and with family it can be! You need to apeak to the OR about work abroad but if its part of your job then surely you will be ok to do it. I haven't told anyone at work or family or friends - but that's up to you. Your tax code is changed to zero so you may need to explain or deny all as some have done! I haven't had to deal with a car but my understanding is that if they decide there is money to be released from your car and take it from you then they give you money to purchase one at a value they think is ok. I am sure they won't put you in a position of losing your job and I haven't heard of anyone being made to use public transport. A BR expert will be along soon to add to this. Take care

Welcome to the forum,
Working abroad is different to holidays and there is no limit on how often you can go abroad, but there is a limit on the allowable expenditure for holidays abroad.
Your car is only marginally above the £2500 limit and it is obvious not having a car could affect your employments so explain this to them and you may well be allowed to claim your car as exempt property.
If they do take your car to sell they may give you the £2500 difference to purchase a cheaper car, but for the sake of £500 as I said they may allow you to claim your car as exempt property.
