Posted - 20 May 2008 : 19:48:10 Hi,
Went BR yesterday and am worrying now that I may have a credit card (with nothing owing) floating about in the ether somewhere. I dont physically have the card, and they havent sent any statements for 2 years so I forgot about it. It is only when looking at which creditors I paid off 2 years ago with 65K from the house I saw "Natwest Mastercard". I cant remember if its active, or if I cancelled it...but I didnt put it on the SOA as I owe nothing on it.
Am I in trouble or should I just mention it in the interview?
Also....I am a secretary on a dormant company my eife started. I was only added as secretary as a convenience, and my wife sent off a 288a (or is that b) form on Friday to have me removed as secretary. Should I have mentioned this in the SOA and is this going to open the company up to scrutiny (we didnt keep records.....wasnt worth it really as the website never took off).
Finally...should I be contacting my creditors and telling them I am BR now? I havent done as I assumed they would all find out soon enough.
Regards

Posted - 20 May 2008 : 22:02:38 Hi Indy,
I had a client who went Bankrupt with £270k worth of debt by the time the Trustee had finished the investigation the debts were far in excess of £500k. He ended up with a 7 year Bankruptcy Restriction Order.
I wouldn't worry about the one creditor especially if they were not owed anything
Kind Regards,

Posted - 20 May 2008 : 20:13:18 I had a client recently who got 250 hours community service for missing 14 credit cards off her statement of affairs, so that perhaps puts it into perspective!

Posted - 20 May 2008 : 19:53:57 A quick call to NatWest ought to determine whether there is a missing card or not.
You can still act as a Company Secretary when your are bankrupt, but this hardly matters if the company has ceased trading.
The OR will contact all of the creditors, so you do not need to do this.
