Posted - 04 June 2008 : 13:45:54 Hi, i am about to apply for bankruptcy but i have recieved a letter this morning from westminsters solicitors " notice before legal proceedings" they say that unless i pay the debt within seven days they will as instructed by RMA acting on behalf of American Express issue legal proceedings.
Can you advice me as the letter also says they will send baliffs to seize goods, it will be at least another week before i can apply for my bankruptcy should i contact these people and tell them i am about to go bankcrupt?

It sounds like this is one of the computer generated letters.
I would say they have not taken legal action yet therefore will be unable to instruct bailiffs until they have obtained a County Court Judgment (CCJ)
This process will take at least 14 days for you to receive the claim form which you have a further 16 days to reply so I wouldn't worry if you are going Bankrupt in the next week or so.
Ring them as M & V says and also don't worry if they say that they'll continue with or instruct the legal proceedings....it can takes weeks to go through the court process.

Posted - 04 June 2008 : 13:57:23 Hi mt01 - I would give them a call today. Tell them you are going BR and will notify them of your BR court ref number as soon as you have been. That should keep them happy - after all you are saving them time/money by taking control and declaring yourself BR. Don't be worried by threats of bailliffs - it's just their way of putting pressure on you. Not nice I know! Give them a call this afternoon! Good luck!
