Two weeks ago when i phone the court for a date to go bankrupt i explained my partner claims jobseekers allowance so i would be applying for the £150 court fee off. I was told that was fine and i just needed to take proof. I just phoned again to see if i could use my partner's signing on book as proof and was told (by a not very helpful woman) i dont qualify for the reduction as IM not claimimg the JSA, my partner is. He claims for me as part of a couple so i dont understand this. I dont have the extra £150 to pay and im supposed to be going to court on thursday. The lady on the phone didnt even have time to tell me which paperwork i should be taking with me. I hope their not all like that!
I feel so low, this is all never ending  |

Hi All, I tried ringing the DWP but because of a mixed up at their end my partner had to make a rapid reclaim so we dont have proof he's clamimg again yet. Also when i asked for a letter to confirm this included me i was told no they dont do that, i need to get the court to ring the DWP when i go. I really can't see them doing this myself but we shall see tomorrow morning! Now trying to make a copy of my forms but keep printing them upside down! LOL x |

Hmmm...does seem strange. When a partner is claiming for you as a dependent then you are bound by the same rules for eligibility.
Can you not get DWP to write a letter saying you are in receipt of JSA - have you tried popping into your local Jobcentre and hoping for a friendly face - even a stamped and dated compliment slip.

I am a bit bemused, as the couple I spoke to were in exactly the same position as yourself and they both got the discount, I witnessed it!
Perhaps it was because he was filing for it as well as her?

I think that it is very firmly set in tablets of stone at the Insolvency Service that you can only claim the Court fee waiver if you personally are the recipient of benefit and not your partner.

I rang the DWP and the court again this afternoon and it seems like even if i was to get a letter from the DWP proving my partner claims for me i still wont qualify for the £150 off!
I'm annoyed because for the last 8 mths or so Ive been told I'll only have to pay the £345 and I've managed to get that together-just! so now i have to find another £150 by Thursday I'm never gonna manage it. I thought the whole point of going BR was because you have no money! Better get grovelling to the in-laws again i suppose LOL |

Hya Cat,
I went bankrupt last Thursday and there was a couple there who I got talking to and he was claiming for her and they both still got the £150.00 discount!
They brought a letter from the DWP but because it was over a month old they were sent over to the local job centre where they were told to ask them to fax or email them with a letter with todays date on it to prove he was claiming for his self and his wife, when they got back to court with the letter they were both given the discount no problems!
I am sure it should be ok, I would be inclined to think that all areas abide by the same rules?
I too was petrified about court but everyone was so nice...Really!

During my BR, everyone I dealt with (including the judge and OR office) was really friendly, helpful and understanding!

Generally speaking, the courts and the OR offices are friendly and helpfuk. Unfortunately, it seems you just caught someone on an off day!
