Posted - 11 June 2008 : 10:26:00 Hi Guys Need a bit of information please, we are still haveing loads of correspondance from the examiner dealing with rob's br and today I had a letter saying that because rob did balance transfers from my cards to his under section 339 and 341 the constitute gifts and I have to pay it back and how do I intend to do it. I just want to explain to you all tha over the course of the last few years we like a lot of people transferred money from one card to another so we got the lower interest rate. These transfers were sometimes mine to his or vice versa. I am therefore paying off my credit cards some of which the balances of the past few years would have been transferred frim Rob. I am also going to have to pay back the joint overdraft.
I have written a letter to them expaining this and also telling them that I am on family tax credit and child benefit and that is all the income I have. I also mentioned again to them the fact that we had no intention until march of this year that Rob would go bankrupt and that he wanted to do IVA but couldn't.
Does anyone know what will happen about this money and if I will be taken to court of anything.
I am a little worried but have spoken to the examiners manager who told me to put it in writing.
Also rob has had a £300 rebate from tax what should we do with the cheque

Posted - 11 June 2008 : 11:27:09 The main problem with this is that the effect of moving monies around from your husband's cards to yours is that you have created a debt from you to your husband which the OR is saying has to be repaid. They may well accept your argument, that this was swings and roundabouts, and if you cannot afford to repay the debt, then I would suspect that no further action will be taken.
The tax rebate cheque needs to be handed to the OR.
