I spoke to the OR this morning who is confirming the meeting for next week. She indicated that it looks like a simple case.
My question is - The OR said they will be taking my car and giving me 2k to buy a new one. I confirmed with the OR that it wasn't a requirement for me to spend it all on a car and was completely up to me what I spent it on. As I have been made redundant and have a few pennies stashed in my quilt (approx 1.5k) If I decided to keep the 2k and the rest of my hidden money and travel to Australia, would this be acceptable? I have already applied for my working visa so I hope so!!!!
I have been burdened with debt for the last 6 years and have no other assets other than my car. I have longed for a fresh start and how better than ozzzzz!!!!

Posted - 15 June 2008 : 19:31:20 you shouldnt abuse the bankruptcy system by keeping money stashed if you get found out you will be in a lot of trouble. |

Posted - 15 June 2008 : 18:03:34 First of all you need to disclose those pennies under your quilt as an asset in the bankruptcy, and if you are being given £2,000 to pay for a car then that is what the money should be used for. If you don't need a car then you don't need the allowance, which should then also be retained for the benefit of your creditors.

The OR will examine your conduct prior to and during your BR. An expensive holiday would be frowned upon, but if you are working, I don't see an issue. You may want to check with the Australian High Commission/Embassy whether a BR would preclude you from obtaining a visa.
