Well i finally went BR on Thursday and it went much easier than i thought!

Everybody was really nice and friendly even the judge!
After getting my BR order typed up i had to go see the official receiver although i'm not quite sure the lady i spoke to was my OR.
Anyway she told me my co-op cashminder account wouldn't be frozen but she told me I'm not allowed to keep my mobile phone contract but that i could get another one. I went straight to vodafone shop and explained my situation and was promptly told my phone would be changed to pay as you talk (which it was within 2 hrs) and that i would NOT be allowed another contract.
Does anyone know why the OR would say i could get another contact?

I wont have to pay into an IPA as I'm on benefits but I'm a little worried I'll have extra restrictions put on me after the 12 mths because the OR kept asking if i had actually paid off any of my own debts with the bank loan and credit card i had and not just my partner's.

What do you guys think? The judge seemed to think i will be BR for longer than 12 mths because i was recently convicted of benefit fraud (so they say!)although that had nothing to do with going BR and i have to pay £7000 of benefit over payments back anyway as they couldn't be included in the bankruptcy.
I feel like i should be relieved it's all over but im not sure what to do next still.

Reply to Mountain street, I was already convicted of benefit fraud before i petitioned for the bankruptcy so not sure if i will still be given a BRO or not. Im not sure whether your situation will come to light, maybe one of the forum's experts could help answer that. Good luck tho

As a "belt & braces" excercise, I would suggest your partner does all three .... just to be sure!

Hi Cat, interested to know, were you already convicted of benefit fraud before going BR or did this happen as a result of Going BR ie, did the investigation into your affairs bring this up. I am worried because I also have committed benefit fraud in the past, because of debts it was the only way to survive, I am worried that this will come to light as a result of BR, and that I will get a criminal record. I'm so glad I found your post. Thanks for putting it up there. Mountain Street.

Ive just been looking online at the notice of disassociation thingy and im confused! Does my partner have to call all 3 credit agencies and ask to fill one in? Does in have to have a copy of his own credit file? Im not really sure if we have to do it or not. Sorry to sound so silly!

Hi Cat,

You wouldn't have seen the actual OR, but rather one of the examiners.

Just sit tight for now. The OR's office will be back in touch if they need anything else.

Thanks Julian, I didnt actually see the OR (I dont think) and the interview only lasted about half hr but ive since been sent some forms that i signed and sent back with 12 mths bank statements. I take it i just wait to hear back? Thanks

But iam repaying the benefits over payments. I set up re payment plans with the relevant agencies before i went bankrupt so although i cannot pay off the bank loan and credit card im having to pay back the benefit over payments i received.

I would not think that benefit fraud would give ample grounds for a suspension of discharge - which is usually given if you fail to co-operate with your Trustee. This might result in you being asked to accept a Bankruptcy Restrictions Order however.
