The judge does have the power to decine a bankruptcy order if they don't believe it to be in your best interest. The most common reason this would occur is if you were in an IVA which has failed, but do not present a lettewr from your IP and/or a certificate of failure.
The judge is unlikely to giver any guidance on the process, but the OR should let you know what the next steps are following your initial meeting.

Posted - 16 June 2008 : 13:24:20 From what I understand, so far, when you submit your SOA etc., you go before a judge or an official of the court who will issue the BR order (can they refuse to give an order? and if so why?). Then they put you in touch with your OR. You later have an interview with the OR either over the telephone or face to face. This is what I want to know: are you infomed of what to expect at the beginning of the process depending on what you put in your SOA and what the judge relays to the OR, during or after the personal interview with the OR, or later, according to how you comport yourself? I hope I make sence. |

The OR usually tells you what the likely process will be and the timeframes involved. Is there anything in particular you need to know?
