Posted - 16 June 2008 : 13:18:54 Hi Julian glad your about today.I dont know if you remember but I had my OR interview on Friday all went well, got an IPA for £199p/m which I was kind of expecting.Im okay with it. If you remember from my other posts I was getting harrassing phone calls from a Payday Loan Lender saying that I took the loan out with no intention of repaying it - and the Police will be around soon to arrest me.Well... ..at my OR interview the chap said that this Payday loan company had made a complaint about me to his office saying that I'd said on the phone that I had no intention of repaying them.The OR asked was that true , explained that On numerous occasions that had called me , threatned me with the police, called me a thief, would call my work etc.BUT I did point out to the OR that at the end of most calls from them they would always ask if I was going to pay them direct and my response was my finances are in the hands of the gods(not really the god bit) Offical Receiver.I offered the OR a copy of the transcript which I jotted down after each call and the OR just said 'pop it in the post'.I even went so far to metion I phoned the police to ask If I could help with anything! Do you think this will be the end of the matter , as it is really just a case of there word against mine? What will the OR do now? Many thanks |

It is a difficult one to call. The OR will examine your conduct prior to and during your BR. If the OR feels you took this loan with no intention of paying it back, they may look to a BRU/BRO. Given the small amount involved, I would be surprised if they take any further action.
If the OR considers you for an early discharge, they will write to all of your creditors to see if anyone has any objections. Given the way this particular lender has reacted, I think it's fair to say they will object and you'll serve the full 12 months.
