I declared myself BR on May 13th 2008 interview 4.6.08.

I did make enquieries re IVA but was told that I didn't have enough excess income.

I decided togo BR, my friend did this last year and on her advise I exhausted all my credit during march and april. My payments had always been on time and sometimes more than the min its just that I reused my credit. Most of my 24k debt was from living beyond my means. Upon deciding to go BR for a fresh start I decided not to make my April payments so my last payments was march and although I didn't take on new debt I did increase my debt by using my cards in april (to exhaust credit) How do you think this will look getting a bit worried after reading a post about fraud procecution.

Hi DM

Viki is right, you won't have to explain to the Judge your reasons for going BR, he's only really there to grant your petition, so no need to worry.

Hey DM, from what I gather, the judge doesn't really discuss any details like that with you, if you even have to see him/her at all. I think that would be discussed over the phone with the OR so don't worry. You'll be fine. Viki X

Very interesting thread. I wasnt worried about using my credit but I am worried that we have never made a payment to egg. Hand on my heart I took the card out to pay my mortgage, and planned to clear it £1250 when I returned to work later in the year. About one month later we realised that we could not 'tread water'any longer and thats when we considered IVA.
I hope the judge will let me explain this to him.

I know exactly what you mean - I hovered somewhere between complete panic and total excitement at being debt free.
BR is a really weird thing to put yourself through - all the debt problems you have hidden for ages are suddenly exposed and you would never dream of putting yourself in front of a judge in normal circumstances!
It does get better I promise - you'll suddenly realise you haven't thought about debt for days and be able to look to the future.
It's a great feeling!

I can't help but worry but hopefully things will be ok. I suppose I have a small debt compared to others and I am hoping that the fact that I did try an for an IVA will also help.

Hi hun

Dont worry about BRU/BRO's the likelyhood of you getting one is very low, if the OR was to give everyone a BRU/BRO who did the same as you then most of us would have got one so please dont worry. Why dont you check the Insolvency site and read the notices of others that have been given them, you will find that most on there have done far worse than you. Even if you did get one and lets say it lasts for 3 years, your BR will stay on your records for 6 years anyway so it wouldnt make much difference! Try not to worry.

Hi tess - you honestly have nothing to worry about. Everyone going BR uses up all their credit and stops paying creditors to save up for their court fees.
I stopped paying my IVA for three months to get the money together!
I went BR on 18th April and had my OR interview on teh 9th May - so far I have had one letter from them saying they have no interest in my car.
It's a strange feeling being debt free and having nothing to worry about - but you are!

Yep...in and out and never regretted it for a single second. It's scary i know but you will be fine...i promise, i didnt have these people on here for support but these comunity like forums are great for keeping your spirits up and after its all over you will probably find that you want to give something back to the newbies yourself.

Please dont worry about it, your not the first and you wont be the last, its been done loads of times and the OR is used to seing it. So please.......its nothing to worry about!
