Posted - 22 June 2008 : 08:23:44 I'm on IVA for 2 years now and i wont be able to pay the required amount this coming july as i will need to move out of the country to stay in another country for good. I will have no job to make repayments. is it possible for me to apply for bankruptcy? |

In addition, most courts would request either a letter from your IP saying the IVA has failed, or a Certificate of Failure before processing your BR.

Do make sure that you inform your IP of your intentions, if you have not already done so. They will need to keep your creditors informed, and under the terms of the arrangement may even be able to pay for the bankrutpcy application out of the funds they have already collected from you.

You can indeed petition for your own BR, whether you are in employment or not. As long as you have the court fee of £495, you'll be fine.
