I am new to the forum and was wondering if people could give me some advice. I have made myself bankrupt on 2nd May 2008.
I split with my ex partner and we have roughly £130 k debt through a joint mortgage and unsecured loan both with Northern Rock done by 125% mortgage. Both myself and ex have gone bankrupt. The property was reposessed in June 2008.
I have had my interview with OR last week. I only take home £947 per month and have outgoings of £839 not inc any allowances which nobody has explained to me. I don't have a car, as i do not drive. I'm in a rented property and do not have any savings or valuables.
Does anyone know how much i will have to pay back, as this hasnt been discussed with me? I'm rather concerned i'm going to be totally left without any spare money.

When you speak to the OR, say that you were concerned you would get an IPA as you didn't feel you could afford one. If they were intending to give you an IPA, then you can tell them about the stuff you feel you would like included in your expenditure

the OR may not receive the call favourably but I would call him/her tomorrow and explain that you have inadvertantly neglected to list the Denplan payment and prescription fees. This would bring your DI down to nil payment provide all other expenditures are accepted by the OR. Please let us all know how your call is received by the OR. |

Posted - 10 July 2008 : 22:36:38 As you had already mentioned that your figures did not include allowances, then these and your dog insurance ought to be included. The OR will generally allow a holiday budget as well, but as Assist mentions everything is down to the individual discretion of your examiner.

Posted - 10 July 2008 : 22:32:19 there wasnt a column to fill in on the SOA for dentist and prescriptions, which i pay £17 per dentist for Denplan and 7.25 for prescriptions, can this be added when they contact me with regards to the outgoings? also whats happens with the allowances, i have a dog which i would like to insure as i have no spare money if anything happens to him. What about holidays etc? |

Posted - 10 July 2008 : 22:25:47 Hi unfortunately it is clear there is little uniformity in respect of decisions made by the various OR offices. What will be allowed, what won't.
Strictly speaking if a disposable income of £108 per month has been declared, the OR should propose an IPA payment at 50% of your monthly DI, £54 per month for 36 months. (Total £1944).
I very much hope that the OR in question views your situation favourably. Especially when, for the sake of £9 per month ie if your figures had shown a DI of £99, you would have paid nothing.
It is precisely this and similar scenario's that lead me to cringe whenever some on this forum state the SoA forms are simple and you should do them yourself. I have my fingers crossed for you northernlass24. |

Given the figures you have quoted, I would be suprised if you would have to pay anything to be frank, however this is at the discretion of your individual examiner at the OR's office.
