Posted - 11 July 2008 : 21:23:15 Hi all, we are going bankrupt on the 21st of July (I had to phone up the court and get an appointment as they are very busy at the moment !)and we are moving into a rented property on the 26th of July. I'm a bit worried because I get paid on the 23rd of July into a Co-op cash minder account and we need my wages to pay the first months rent and the bills for the new property, so I was wondering how long is it from declaring yourself bankrupt that the OR freezes your bank accounts? If they freeze ours before i get paid I wont be able to pay the Landlord the first months rent, which wont go down very well! Thanks Helen x

Posted - 12 July 2008 : 10:04:03 I called the bank as soon as i got back from court, i told them that my official receiver had no interest in the account and she would contact them at some point to verify that claim. The bank made a note of it against my account so that when my bankruptcy was published in the london gazette it would not be frozen. I believe that they will only freeze your account if they see the publication in the paper and its the first theyve heard of it. So as long as you keep them informed before publication the account wont be frozen at all. They dont want to freeze it and neither does your o/r so just tell them as soon as you get back from court. One other thing, make sure youve not got loads of cash in the account or the receiver may freeze it to claim the cash to pay creditors etc, just have enough to pay your bills. I think the o/r is under an obligation to make sure you have enough to live on once you go BR so they wont be interested in the account if theres just enough to tie you over...Try not to worry, they are not out to get you. |

Posted - 11 July 2008 : 21:30:28 Your accounts will usually freeze on the date of the bankrutpcy order, but they can be unfrozen very quickly by a call from the OR to your bank - of course this is at the bank's discretion.
