I have been paying an iva for the last 38 months and have not missed a payment each year i send them my wage slips i have and p60 and fill in my income and expenditure form. However this month i get a letter from them saying unless i provide them with either the last three years wages slips or my last three p60 (which i no longer have)they are going to end my iva and declare me bankrupt. I have recently changed jobs and had to take a £1.58 per hour pay cut and am finding it hard to pay it. Any advice on what i should do would be appreciated

Thank you for your time

james

Hi James and welcome to the forum

I suggest that you write back to them and say that as they did not ask for these at the end of each year, when they should have done, that you have destroyed them as you felt they were not needed. A judge is likely to tell them to stop wasting his time if they seek a bankruptcy order on this basis, and you will have grounds for a complaint to their regulatory body.

If you are struggling with your payments, demand a face to face interview with the IP to discuss the missing wage-slips and to negotiate reduced payments. I suspect that the letters you have received have not even been produced by the IP directly, but a relatively junior member of his/her team.

For an informal chat about any financial difficulties, or advice as to the options available, I can be contacted via my website - www.melaniegiles.com
