Posted - 13 July 2008 : 22:21:14 It is likely that the rebate will be sent to the OR directly in any case, but it is rightly payable to the Trustee as a debt due to you at the date of the bankruptcy order.

Posted - 13 July 2008 : 21:15:21 You will also have signed 2 forms shortly after the br - sent by the OR's office.
The first one gives the OR authority to speak to the Tax office and see if you are due a rebate.
the second form incorporates the purjery act
the right thing to do is not spend the money and let them know asap. They will see this as positive behavour from you and will put you in a better position re early discharge etc - as you have cooperated with the OR.

Posted - 12 July 2008 : 16:34:19 One of the experts will be able to tell you for certain but it may be that you have to pay the monies to the OR, however as the rebate relates to a period outside your actual BR then you might get to keep it. Is your current tax code NT?
