 OR Interview - Not very Satisfactory!!!

Hi All S10 here,

I had my OR interview on Thursday, supposedley at 10:00am. Eventually OR rang at 10:30 saying due to computor issues she was late, also because of this never had the time to read my submitted documents(that I hand deleiverd myself). Started the interview which kept stalling due to the computor system failing. All in all interview took over hour, and then I disputed some of the living expenses. OR advised she thought £186 was adequate for food and toiletries and cleaning products per month?? Are these people in th e real world? £10 a day is what I estimated (£280) per mnth) Then to finish she advised that she was not satisfied with the reason I went BR? I cant make things up, I spent beyond my means end of story?
Please can anyone advise me on why she would not accept this reason and what I should say when she rings back next week ONCE she has had the chance to read my file??? Not very satifactory in my opinion.

Absolutely. Unfortunately, there does seem to be some inconsistency across the country in what ORs will and won't allow. Keeps us on our toes!!!

I'm sure you are right Julian, and I am aware that the OR examiner's seem to have a lot of discretion over this so there is no real consistency.

Hi Melanie,

In my experience, allowances in BR for a couple are nearer £350 for housekeeping (food etc). I've had many cases at this level without question.

The CCCS maximum allowance for a couple is £295, however the OR's examiner can use their own discretion in this regard.

Just a quick one - If both partners are applying for BK, am i right in thinking that the second partner has less of an expensiture on housekeeping? For example, I would maybe be given £180, my wife £100?

Well seeing as bankruptcy is a pretty final matter, whether she accepts your reasons for filing are good or not it is all now rather academic - as the District Judge did! I am afraid to say that £186 tends to be the highest acceptable allowance for housekeeping - it accords with both the CCCS guidelines and the Common Financial Statement, so I am afraid that you may have to accept her ruling on that point.
