Hi Folks,

Just about to see a representative from the CAB regarding our bankruptcy however have a feeling they won't be entirely helpful.

So, quick question before we do see him.

"Anyone can declare themselves Bankrupt under UK law, provice the meet the following criteria:

A. You are domicile in the UK. I.e. You have a UK passport and a UK correspondence address (this could be a family member).

B. The majority of your debt was taken while living in the UK.

C. You are able to afford to pay the associated Court Fees which are £495 (payable in cash to the Court Clerk on the day you present your Petition). Note, if you are receiving certain benefits, you may be eligible for a reduction in these fees.

Now, regarding point C. What if we can't afford that? And what are the certain benefits that would mean we qualify for reduction, and how do we get that reduction?

Both myself and the wife are looking to go BR but that's just under a grand! Seems sort of daft going up to someone and saying "Yes, we've not a penny to pay our creditors - but here's a thousand pounds to prove it!"

Well, CAB wasn't able to provide any more information than I've already found here other than only the court fee being waived if unemployed.
That still leaves up £700 short of the mark for BR :(
CAB have advised us the best way to deal with that is to write to all our creditors and say sorry, no money coming in, no money will be going out - and told specifically NOT to mention bankruptcy. No problem there, saves us a little money but will mean being hassled something rotten as well as still leaving us short for the money :| £700 would pay off 1.5 of our creditors too, a grand would get rid of 2 :/
Now stuck in the Catch22 of bankruptcy.

Hi

In some circumstances the court fee of £150 can be waived. If you receive income-based benefits such as Income Support then the court fee should be waived. But as Suzanne says check at your local CAB.

Hi

Speak to the CAB about this as I beleive there are certain grants available to cover petition costs, and they should be able to give you some pointers.
