Posted - 29 July 2008 : 23:12:26 Good Evening, I hope someone can help me with this question, I don't want to upset the OR but I have recently had a letter regarding early discharge I declared myself bankrupt in February 2008. The letter asks me to complete another income and expenditure form before deciding to file a notice in court for my early discharge. However, I have found it hard managing with my IPO of £250 per month and have not notified the OR. I was just about to call them to tell them that the increases in petrol, food, and utility bills have left me with no surplus income at all, in fact when I filled the forms in with more realistic figures (I didnt have really true figures when I first filled my I & E in on the bankruptcy form as I had only just moved into rented accommodation and the true extent of the utility bills had not been recognised at that time. I have now completed this new I & E form and find to my horror that I only have a surplus income of £230 per month now, having added on my increased petrol and household fuel payments. My IPO is £250.00. Has anyone ever heard of the OR reducing or deleting an IPO altogether? I have not asked for anything in excess, no holidays, no haircuts and no contingency. I really think I messed up with the first I&E form, everything looks OK on paper but 3 payments in and it's not going to work.

You should contact the OR and let them know of your change in circumstances. You also need to get the I&E back to them asap as until you do they will not allow the early discharge. I would suggest you send in your new I&E with a covering note letting them know of your change in circumstances and start making lower payment of around £100 per month.

I do beleive that the OR can be notified about any changes to your I&E all through your bankruptcy and IPO.
It may be worth contacting them with the form anyhow and advise how you have been struggling. They are only human and dont want to see people struggle.
Thats good news about an early discharge so I would def get intouch with them and explain the situation to them.
I hope that i have given the correct advice, i dare say if i have said anything that is not correct then the forum experts will put it right, but this is how i have been led to believe that they deal with it.
