Posted - 29 July 2008 : 23:16:55 My husband had his flat reprossesed in the early 90s and there was a shortfall of £35kish, he ignored all letters from them until before we were married about 5 years ago and has been paying £25 a month. This debt was long before he met me, am i liable as they just keep chasing him for more money. They do not know he is remarried as he was married to someone else when this debt occurred, he signed a disclaimer so his first wife is not liable for the debt. He is unemployed and gets £60.50 benifits but he is concerned for me and my home which he does not have any claim too as it is all in my sole name as i did right to buy before we were together. Could he go bankrupt and are my sole assets safe even though we are now married?

The only way any Trustee could have any claim on your property is if your husband makes a contribution to the household. If he is on benefits then it is unlikely he is.
