With 3 months left it's as good as too late to offer early discharge therefore I do not think you will now be offered the option nor would I expect you to receive I/E forms at this stage.

Thanks John,

As I only have 3 months left until I am automatically discharged, when would the last chance be for them to send me I and E forms.....i.e. 4 weeks before my discharge date or a week before?

Basically, I don't want them to do an early discharge for me, I don't want to fill in I and E forms, I just want to be automatically discharged......

Thanks

Just on early discharge, you wouldn't expect to receive I/E forms at the end of the full term.

If I was to go full term, and do the whole 12 months - would I receive an I and E then? Or is it just if you are offered an Early Discharge?

Thanks

Hi
It's still possible for you to be offered early discharge (takes around 12 weeks) but as the weeks go by it would look increasingly that you will go the full term. You would receive the I/E forms at that time. And if you did, prior to any confirmation re the continuation of your contract, you would not enter the fact but, rather, enter your earnings at that time.
Should you subsequently be advised the contract was no to be continued you should notify the OR without delay.

Thanks Assist,

I should be automatically discharged in Nov, so another 3 months to go - woo hoo! They have never said that i would be up for early discharge. If they were to send me I and E forms to fill in - when could I expect them?

I am on a fixed term contract and this ends 31st Oct - so technically I would be unemployed when I was discharged - would I put this on the form if they sent it to me, before my employer told me if my contract would be extended or not?

Thanks

Hi,

Am I correct in my understanding of BRU/BRO's that you are still discharged automatically after 12 months, but the restrictions apply until the end of the term of the BRU/BRO?

Thanks,

I

Hi 369
if you were offered early discharge at any time then you would most likely be asked to complete a new I/E first. If not and it goes the full 12 months then you are unlikley to be asked to do so.

I have not been given a BRU/BRO or a IPA/IPO - and am due to be automatically discharged on the 2nd Nov - will I have to fill in any expenditure forms prior to this? Or will i just be dicharged?

Thanks

Provide you have not been given a BRU/BRO then you are automatically discharged on the 1st anniversary of the date you were declared bankrupt, whether you are notified by the OR or not.
Unless of course the OR offers you an earlier discharge date.

Your name will not be on the Insolvency Register and you may be notified by your OR.
