The or will get them if they need them and please do not worry they will go about their business and compile their information if they require good luck

Posted - 08 August 2008 : 08:01:19 Hi if you're giving up the property any shortfall will be included in your BR, the lenders will not be able to pursue you for any payment after BR. IPA's are often set up by a DD in favour of the OR. Not everyone gets an IPA. The OR will look at your net income figure. Then consider your list of expenditures, he may accept the figures or trim them if he feels they are in any way excessive. Having done this he will look at the difference between income and expenditure (disposable income). If you have a minimum £100 per month DI then you will get an IPA. An IPA starts at 50% of DI, i.e. if you had £100 DI the OR would take £50. There is a sliding scale from 50% to 70% whereby larger percentages are taken if the DI figure is higher, e.g. if your DI is £500 per month the OR would take £350 (70%).

If he wants to stay as is then well when you have gone BR you start your new debt free life he may well then realise when the letters come for him to cough up fors yours and his debts that he has lost out on something good. I went BR on monday this week and to be honest like you i was well nervous the folks on here helped me loads and i also used the online site to fill in my forms and when i has any questions about the form i asked on here, and hey presto you get the advice you need. I dont know if you know the site but its less stressfull than writing them out its the following if you want it http://www.insolvency.gov.uk/index.htm You take care and dont be scared, i know its easy for me to say but take it in your stride and keep posting!
