Petes problem Posted - 03 August 2008 : 23:20:02
Hi

I have just been made bankrupt and am set to see the OR this week but I have not yet got my papers together as I have more pressing problems one of which is trying to get somewhere for me and my wife and two tenage kids to live as we are in rented and the tenancy has come to an end so we need to find new accomodation of three beds that take a dog. Any ideas as the Estate agents are not happy to help a bankrupt?

Also I am seeing the O R this week but will not have the paperwork together do you think he will give me an adjournment for sa 10 days time? I do not have ant assets so I am not trying to hide anything.
Can anyone help. please?

Pete

Hi Pete,

I agree with Eamonn about going to your local council offices. They will put you in emergancy accomodation (although this could be anywhere in your local borough). They may well try and 'scare' you by telling you that you may be housed further away or in an area that isn't very nice. From experience they say that to tell if you really do need to be housed or not. After that you will go on the social housing list for a permanent property with whoever your local housing association is.

It may not be ideal but there is not such a stigma attached to council housing anymore (I live in a flat rented by my local housing association and it is fine).

Just make sure you have in writing from your landlord that you need to vacate your current home. Also it would help if you could get some sort of correspondance from estate agents to confirm they won't help you once you are bankrupt. That way the council will see that you have made an effort to re-house yourself and your family.

Hope it goes OK and keep us updated.

hi pete
if you are due to be made homeless go to your local council
they have a duty to give you some sort of accomedation it may notbe the best but at least you have a roof over your head

Hi Suanne

Thank you for the advice.

My present landlord wants his property back and gave us notice before the B hearing. He did not know there was one but he is not prepared to change his mind as he wants it for himself.

I note what you say concerning private lets but they seem to be few and far between. We shall just have to persevere.

Regards

Pete

Hi pete

If you have a face to face interview, I wouldn't worry too much about getting all the paper work together by then. The examiner will go through the SOA with you and fill in any blanks as part of a statement.

Why do you need to leave your current home, are they not willing to extent your tenancy?

Some have found more success taking private rental properties rather than those through an estate agent.
