Posted - 07 August 2008 : 07:20:39 I still have so many questions as many i you will know i have a mortgage and home owner loan with my husband who i have split from, he has recently decided to move with his parents to their brothers house, leaving me to sort out putting the house on the market and keeping it clean, he does still pay the home owner loan, gas rates and sky, and i pay for mortgage, electricty, water,telephone,food for myself, bus fare, and general living expensers. im finding it very hard to keep up with the mortgage payments due to the fact that i go overdraft limit every month thus encure charges. i have the forms to declare myself bankrupt but im worried that the OR will make me still pay the mortgage and maybe some towards the home onwer loan, is this true or will i get a fresh start and only pay what i can. You will see from my last posts that we live very close to his family and im worried what they will do, i wish to move back in with my parents as i cant afford to rent and i feel that this will help me, but i will have to leave my job as well, will the OR let me do this.

The only effect your bankruptcy will have on your husband is that the lenders will go to him for all the secured and joint borrowing. If you stop paying the mortgage, the lender will probably commence possession proceedings, and any subsequent shortfall will be payable by your husband as you would not be liable because of your bankrupt status.
I think you are going to have to look after number one, just let him know what you intend to do and let him sort his end out.
In terms of having to leave your job because of relocating to live with your parents, the OR will be very understanding of this as it is a matter of having somewhere to live.
