Hi all,
Well I have written many posts about my pre BK hearing and now I am getting ready for my OR interview.
I am worried about the BRU thing so I thought I would ask some advice.
Up until 2006 we were paying all our debts, in full and on time, is we took a loan or did a remortgage we paid of some of the bigger debts or refinanced to make payments easier.
End of 2006 after a builder let us down and took us for a ride we had to use some of the cards we have cleared in order to finish the loft conversion, the stress of the builder meant i was unable to concentrate at work and so lost wages, the only way then to live until i went back to work was by using the OD and then when I went back to work I could only do part time meaning loss of income of about 80pw.
I wrote to all my creditors and explained and they agreed on 6 monthly basis a reduced payment plan, as we did try IVA but due the amount of dedbt 68K and the disposable income we had they said an IVA was not really feasible.
I did what most people do and to get the creditors to agree i paid what they asked if only to keep them off my back and stop any further action, this in turn left me with about £40 pw for food for 5 of us.
I thought i was doing the right thing and i did not want to get stressed out again, I also got 1,800 on my catalogue accounts up until Jan or Feb this year which consisted of xmas gifts for the kids, stuff for me for uni, kids clothes and also some household items, I have not touched any credit cards for 2 years the only debt we got added to and i feel was a nescessity as we had no spare income was the catalogues, of which i made there agreed repayments and the current rate up until Apr or May then I just realised that I could not do it anymore.
I have not hidden anything, I had to get gifts and house stuff somehow and now i feel that I will get a BRU basaed on that.
I honestly thought that we could pay these debts and then me going to uni and bettering myself that we could get them paid off and back to normal payments, but we just could not and I could not feed a family of 5 on £40 pw and it came to a head.
Now i feel that we will be penialised for the catalogue debts even though they were small as we were struggling at the time. This money to pay them came out of our food money, I also had to look for bargains on ebay and Amazon esp for my stuff books etc for uni.

I have my interview on Tues, we have just looked at the London Gazette online and we are in there.
Oh well its to be expected thats part of the parcel. My stress levels have gone down now. I feel so much more relaxed, we have the hosue to sort out now but I doubt if we will find anyone to buy the BI as the OR asked as my dad said he might be able to but i dont want to be indebt to him and to be honest when the remortgage comes next year then we may have trouble getting a decent monthly payment and so i think its better for the OR to advise that they organise it for sale.
Its best in the long run I have provisionally asked that we dont do anything about the house till after my eldest son who has a learning disbality finishes school as he finds it difficult to adapt and I dont want our mistakes to have an impact on my sons.
Anyhow I will let you know how we get on.

I guess it's natural for many on this forum to assume that almost any and all borrowings are in some way a form of misconduct. It comes from the underlying feeling of guilt that we all share. There's no gambling involved here, no misdirection of funds, looked at an IVA and entered an informal arrangement.
I see no grounds for a BRU/BRO.
