Stressed girl Posted - 10 August 2008 : 10:41:12
Im filling in my forms online and have questions that im unsure of how to answer.

1. The reasons for going bankrupt do we need this to be lengthy or what have others done. Also I am unsure when the problems really started but we were unable to start paying things around March this year as previous to this we were just moving money about and using what available credit we had. We have had many personal issues which overtime have cumulated to the problem how much of this do we need to explain.

2. The section were you list Credit Cards etc we have put them all in there but again do we list these under unsecured debts? Also im unsure where we show arrears.

3. We are trying to hand the keys back to the lender but are having a battle at the moment and have not been able to do this beforehand so will be at the house for around another month do we put notes in the additional information saying that we will soon be doing this?

4. Also on my husbands forms his wages very by £50-80 per month depending on a bonus he gets do we take an average or whats the best figure to put forward.

5. Also housekeeping has risen since doing our I/E with CCCS due to fuel prices etc can anyone tell me if the OR is allowing for these expenses or what is the figure allowed?

Any help would be appreciated as we are really stressed about our BH on Wednesday. Thanks in advance.

Hello stressed girl. My husband and i petitioned on friday and did the forms online. I will attempt to answer your questions but i am sure an expert will be along to help also and correct me if i am wrong. Q1. Put in that you first had difficulty paying your debts in march, as to the explanation we used bullet points on a time line, when you are interviewed by the OR you can explain in more detail if they need it.
2.credit card details go in unsecured debts, the amount would be what is owing on each at time of petitioning.
Q3.If you are handing your keys back to your lender, ensure that you include your mortgage on the unsecured section as well as the secured section to cover any possible shortfall. you can add the move into the additional information also but again you can explain this at the OR interview.
Q4. My husbands income varies by up to £500 per month, you need to take an average from the last 3 wageslips, you can also explain this in the additional information if you wish.
Q5. In your income and expenditure, you put the figures that YOU need/spend, these vary from person to person and only you know what you need, the OR will talk through these with you,for example, if you spend £90 a month on electric/gas, list it. you will have bills to show the OR if needed, and they will talk through any expenses they feel need adjusting/verifying, don't forget to include everything and list an amount for contingencies and a modest annual holiday.
Hope this is of help and that i have got it all correct. Good Luck for Wednesday, the court experience really isn't that bad and everyone there is lovely, we didn't see the judge and there were lots of others there doing exactly the same thing!
