Posted - 14 August 2008 : 09:06:09 Well after being a year into my IVA which failed I am now going bankrupt tomorrow! There are so many things going through my head, Ive done so much research, been to see the CAB and am constantly on this site, I think sometimes you can have too much information!
I have so many worries, I keep telling myself that I've done what I can now, completed the forms as best I can and it's now out of my hands . What will be will be!
Last night I lay in bed thinking of so many things:
Four years ago I split from my partner, bought the house for £100,000 and two months later we split. 7 months later I received £7,500 even though we had the house valued at £105,000. This money I received went on legal costs, storage and moving costs. Will they question this money?
I also paid my dad £30 a month for money that I owed him, I continued this into my IVA but it was agreed with my IP that it would come out of my contingency money. After speaking with Suzanne she said that the OR probably wouldn't even mention this amount because in a year (since I was declared insolvent) all I paid him was £360 and it was such a little amount. I am hoping they won't require this money back!
I am worried about my expenditure, maybe it would seem a little high but I have put down everything I pay for, if you don't ask you don't get (that's what I keep telling myself anyway!!)
Will I be able to open a co-op account! I plan on going tomorrow after the bankruptcy hearing.. fingers crossed!
So many questions, so little time!!!! Wish me luck!!!

Posted - 15 August 2008 : 00:07:16 Good luck today Maizie. I went to court last Thursday, had my OR interview yesterday, and lived to tell the tale. It really will be ok, and the HUGE relief you'll feel after walking out the courthouse is better than chocolate! x |

Just wanted to say good luck for tomorrow! I currently work at a bank and to open an a/c you normally just need proof of name (your passport is ideal) and proof of current address. The bank I work for doesn't accept mobile phone bills but they do accept car insurance certificate and or schedule (needs to show your name and address on it, and be in date!). I would take as much as you can just to be sure. Thought that may help put your mind at rest for one thing anyway!- I believe most banks have similar guidelines.

Posted - 14 August 2008 : 14:26:34 HI MAIZIE NOT 100% SURE BUT EVENTUALLY THE OR WILL ADVISE THEM OF YOUR NEW ADDRESS I EXPECT AS THAT IS THE ADDRESS YOU WILL USE FOR THE SOA. ALSO YOUR CURRENT ADDRESS WILL GO INTO THE LOCAL AND ALSO THE LONDON PAPER NOT TO MENTION THE INSOLVENCY SITE WILL LIST THE NEW ADDRESS AND MAYBE THE OLD ONE THAT THE DEBTS COME FROM. I COULD BE WRONG BUT THATS MY UNDERSTANDING OF IT. ONE OF THE EXPERTS OR OTHER MEMBERS MAY KNOW MORE. DONT WORRY ABOUT TOM THOUGH YOU WILL BE FINE. TTFN JO

Rollercoaster... All the ID I have is passport, car registration documents (I moved address on 4th July so driving licence still in old address at the moment), no utility bills (as they are in my partners name) so have a mobile phone bill, a letter from my IP (from my IVA) and my car insurance documents. Would they accept these?
Josilverplayboybunnie... all of my creditors still have my old address as I have now moved... will all letters etc go my old address or will the OR notify them on my new one?

Posted - 14 August 2008 : 11:43:27 Hi Maizie Just want to wish you "Good Luck" for tomorrow. Its not as bad as you think, the interview that we have later is not that bad either. You will be fine, honestly the relief you will feel after tomorrow will be immense and although im still waiting to hear about things like the car and how much we will have to pay, that is nothing compared to being scared of the doorbell, the letters each day and the phone calls that came before. We have only had about 5 letters from our creditors since we went BR and had one today saying that the account will now be dealt with the OR and through their solicitors and so we should now not be contacted about this account at all. "PHEW" Anyhow good luck you will be fine. LOL JO

Posted - 14 August 2008 : 11:34:10 Feel the same Mazie, jumped the first hurdle, waiting for the second (the interview) Take a load of proof of ID with you to the co op, we had our co op account before and were allowed to keep it (phew)! |

Your reservations are quite normal and you have no need to worry. It will be all over soon and when you walk out of court tomorrow give your self a pat on the back because you will be debt free and at the beginning of a fresh start.

I hope like many that when you walk from the court you will feel the relief from knowing that you're debt free and celebrate in the proper manner!
I understand very well your comments regarding too much, and often conflicting, information but I think it's natural to research as much as you can after, as we all do, having had our heads in the sand for so long.
Tomorrow is a new beginning and the 12 months will fly by with, I hope, not too many worries along the way.
