Posted - 16 August 2008 : 11:58:40 I know me again, Just sat here wondering, what can creditors do after you have declared yourself Bankrupt and up until that date only send letters threatening any action against you.
I am also worried that our Mortgage is through C&G, now C&G are a part of LLoyds TSB, LLoyds TSB are our biggest creditor nearly 3/4 of our debt is through them, can they now put any holds onto our home, make us sell or try to give us a CCJ or anything bad. I dont want them to try any dirty tactics to get there monies back.
Should we be ok as they should not be able to do anything nasty against us as they are different debts?
I have been getting letters from creditors since the BR date have been informed by my OR's office to send these down all of them to the office so that if the debts have gone to a DCA then they will know who to write too etc. I agreed this with them and I am now sending all letters once a week on a Friday to them for there own records plus it gets them out of the way.
Any advice on my above question, is there anything that creditors can do after the BR.

Posted - 16 August 2008 : 12:14:51 Hi jo there's nothing a creditor can do after BR. No continued claims, no bailiff's no CCJ's no charges on your property.
Secured lending does not form part of bankruptcy so your secured lenders cannot be influenced by any unsecured debt you had with them or any other creditor prior to BR.
If you continued with repayments to the secured lender your BR is of no consequence to them and the asset against which the loan is secured is safe unless the OR can claim it.
