Posted - 19 August 2008 : 11:16:47 Hi
I was declared bankrupt on 10/4/08. I am STILL getting horrible letters from creditors. How long does it generally take for the OR to inform them.I have already had my file passed onto the RTLU about a month ago. They are also sending duplicates to my parents house which is rather embaressing seeing as I am 38 years old and rather keep my financial situation to myself! Has anyone else experienced this.I think I am going to have to write to each and every one of my creditors myself which to be honest I did not think I was supposed to do after my bankruptcy hearing. Any advice welcome.
thanks
Nikki

Posted - 19 August 2008 : 14:22:51 thanks for your reply.I found it strange as well that it is taking so long especially as they have passed my file onto the RTLU already.I will take advantage of your advice and write to everyone including a copy of my bankruptcy order and the above paragraph you have posted.
thanks
Nikki

Posted - 19 August 2008 : 13:27:44 Hi I admit this does seem strange and it would be unusual for the OR not to have contacted each one of them by this time.
Write to the ones that are still sending letters, note your BR number, the date of the BR and the contact details of the Official Receiver. Then add the following:-
"I am fully conversant with Section 40 of The Administration of Justice Act 1970. As you are in possession of my bankruptcy details I am aware that to continue to harass me in this way and / or write to my parents address at which I do not live is a criminal offence under the Act and I shall have no hesitation on forwarding copies of any future written correspondence to both the Official Receiver and the Police."
I think that may do it, it usually does. Debt is a civil matter and you are not a criminal, what they are doing is a criminal, not civil offence.
You can look up the summary details of the Act by googling it online.
