Hi

if you evidence the start date of your tenancy and have receipts for deposit & rent, produce copies for the OR and pass them to him requesting no contact with the landlord / letting agent.

It's not guaranteed to work but well worth a try and I have seen this strategy work often.

It will depend on your examiner, if he's sensible then you'll be fine.

julian,
sorry to be a pain but if i infowm the OR that i have just moved in then how could i have missed any payments?

i have never met him, its through a letting agency, maybe just see what comes out in the wash, i could always rent privately where no xcredit checks are involved

Hi Andrew,

In that case, I'm afraid you're going to have to "suck it and see". Ultimately, it's the landlord's decision. It may be an idea(if you get on well) to be up-front about it, so he doesn't panic when he hears from the OR. If he realises his rights aren't affected, he should be fine.

its hardly a good start though is it? i have just paid my 1st months rent and will in all likeliehood have to go bankrupt, the rent is not however a problem
andrew.m Posted - 29 August 2008 : 17:50:49
the thing is i have just moved in
JulianDonnelly Posted - 29 August 2008 : 17:50:35
Hi Andrew,

It may be worth getting someone to look at it. AST's are usually pretty standard and the courts will normally only issue an order to get you out if you are in arrears. Best double-check!

there is a clause stating the courts can order me out if i become bankrupt, oh hell!!
JulianDonnelly Posted - 29 August 2008 : 17:42:44
Hi Andrew,

The OR usually writes to your landlord in case there were any rent arrears. Check your AST to ensure there isn't a clause regarding BR.

i think i can get the bank statements but i have never kept CC statements
andrew.m Posted - 29 August 2008 : 17:38:49
hi julian,
all i have is last months statements, i never saw the need to keep them as i didnt expect this turn of events?
also will the OR be contacting the letting agency?
thanks
JulianDonnelly Posted - 29 August 2008 : 17:35:46
Hi Andrew,

The OR will request 12 months bank/credit card statements from you. Don't be too concerned if you don't have these as the OR can get copies directly from the bank.

Mine went in the local paper. I know I'm warped but I cut it out and kept it. If I ever want a credit card again I'll get it out and look at it!

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
