Posted - 29 August 2008 : 19:12:11 hi all, does anyone have any experience of this, i have just paid my bond and 1st months rent to the letting agent, will the OR tell them or do i have to? its in my tenancy agreement that they can get a court order to get me out if i go BR. andrew |

Posted - 30 August 2008 : 13:45:17 Yeah,it's all a whirlwind isn't it?! We had to take a fewdays off from even thinking about BR when we moved into rented, so I feel for you doing it all at once!
You'll feel so much better once it's done though and you're settled into your new place and are debt free to top it off!!

We're in almost the same position although we've already moved into the house. The OR should really tell the landlord (or in our cases probably the lettig agent, who in turn will tell the landlord), but there have been several cases of people saying their OR agreed not to inform the landlord as the tenant could prove there were no arrears (using tenancy agreement, bank statements showing payment etc).
I was still worried about this though, as like you we had a clause mentioning it in the tenancy agreement. We therefore phoned the letting agent anonymously and asked what would happen if the OR informed them of our BR. They said that they would have to inform the landlord, but that they would tell the landlord that they were happy for us to remain in the property so long as we continue to pay. they said the clause was really there so they can get in quickly and reclaim the property if the tenant goes BR AND doesn't pay. The letting agent were pretty adamant that no landlord wants to have an empty property and that they will likely be happy to take the 'risk' of continuing to let a BR rent the property, because of coursethey have the safety net that they can evict us if we don't pay.
It made me feel much better, and we've decided that if the OR says they will have to inform the landlord, we'll contact him first to put our point across and to try to offer him some reassurance. We've already made an effort to build up a positive relationship with him by calling him from time to time and by being fair on timescales for work we need him to do.Hopefully this may pave the way for him to be reasonable with us too!
Maybe you could make the same anonymous call to your letting agent and see what they say? I'm a real worrier and it definitely put my mind at rest!
