hi im on iva but for some reason i will file for bancruptcy as due to some changes .. my questions is what do you call that term or certificate for a failed iva before youcan apply for bancruptcy ... tnx

Certificates of Termination can take quite some time to materialise. As long as you've at least got a letter from your IP stating the IVA has failed, you should be fine.

Check with your local court, as not all courts want the certificate of termination, although I think more and more are doing so now.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

Have you missed any payments towards your IVA yet?

I have read on here before that the Court (you are not issued an OR until you are bankrupt) will not declare you bankrupt unless you have the Certificate of Termination due to your IVA failing.

Best thing to do is to call your IVA company...you don't want to pay £495 to go bankrupt only to find that they dont accept it as you dont have the Certificate.

tnx 369 ... will the OR will not accept my application w/o it ????my reason of asking is that i would like to book for an appointment but not sure if my IP will issue it at once after three missed payments ... tnx again

I think it is called a Certificate of Termination, you should speak to your IVA company and get one of these, usually it takes three missed payments to get one, but someone on here the other day got one before three months was up.
