Posted - 08 May 2009 : 20:55:39 hi im married considering bankruptcy.have about 37000 in credit cards and on a dmp but interest is still going on so just had enough.the thing is all the cards were taken out by me and the wife is second card holder.if im declared br would they go after the wife for the debt.thanks for any replies |

1. The finance company need to be in agreement 2. your other half would need to pay the monthly payments 3. you would need to satisfy the official receiver that the car had no equity or certainly less than £2000

if your wife has not cosigned any of the original agreement documentation and is definately only a named 2nd card holder on YOUR accounts then she is not liable for these debts should you declare bankruptcy.

I think that if there is a joint loan/CC and one person declares BR then the other person is liable for the outstanding amount but I will let one of the experts confirm this.
You should also speak to the CAB, CCCS or National Debtline who would be able to confirm the situation. |
