Posted - 04 January 2010 : 12:56:59 i AM NOW BANKRUPT AND HAVE MY INTERVIEW WITH THE OR TOMORROW, MY HOUSING CIRCUMSTANCES ARE THAT i LIVE AS A LODGER IN A HOUSE OWNED BY MY EX PARTNER. i SOLD THE HOUSE TO MY EX PARTNER 20 YEARS AGO AT THE CURRENT MARKET VALUE AT THAT TIME. She has lived in the house ever since everything is in her name, and we have no financial connection I have never bought anything for the house, have no involvement in the maintenace or day to day running of the property we have over the 20 years maintained a friendship ( although this is currently at an all time low) but both remain single and conducting totaly separate lives, is the OR likely to deem that I have a beneficial interest in the property. All of the above is provable. |

Posted - 06 January 2010 : 09:28:44 Dare I say I feel it went very well in fact i had got myself into such a state before the interview I still cant believe how straighforward it was. the interview took about an hour at the end the OR advised me there would be no need for another interview and | could expect to e discharged within 5 - 6 months providing everything was in order. Or is writing to my landord to advise that I am bankrupt and to check my lodging fee is paid up to date (no problem with that). I am still in a state of shock really had the first nights sleep in ages. Really hope this is the beginning of a new life, this has been a massive wake up call and I never want to be in debt ever again. I would like to thank everyone on this sight for their help interest and support

I am inclined to agree with John.
You say that the property has been in the sole ownership of your ex partner - that can, of course easily be confirmed at the Land Registry. It certainly is a long time ago in terms of you looking at BR now.
I am sure the ORs examiner will look at your situation and may ask you some questions about your relationship now - but again, I agree with John, if that is the case, stand your ground.

Posted - 04 January 2010 : 13:46:09 Hi so basically you have rented a room in a house for the last 20 years. There are no questions in the SoA or PIQB which relate to properties sold more than 5 years ago.
I suspect you have declared your rent within the expenditure section and likewise any contributions you may make to the landlords utilities. Other than that you live separate lives in every way.
I can't see how it could be argued that you have a beneficial interest although naturally the OR may be suspicious that you may be more than lodger and landlord if he is aware that you both reside in the property and that you were once an item.
A BI would still need to be substantiated though and I don't think it would be. If the OR claimed a BI just tell the truth and stand your ground.
